Nov 11, 2020 at 7:35 AMBGL, BSK and TD thank the Federal Council for the amendments to the StVO regarding the local jurisdiction for individual permits and exemptions for oversized / heavy transports and the extension of the transitional period for (CB) radio operation.
(Frankfurt am Main) – In April of this year, the Federal Council decided that for the application of individual permits for oversized and heavy transports, only the authority in whose district the permit-required transport begins or ends is responsible.
With the resolution of 06.11.2020, the Federal Council advocated changing the local jurisdiction of permitting authorities for oversized and heavy transport according to § 47 StVO.
Intensive Discussions in Advance
The BGL, the Federal Specialist Group for Heavy Transport and Crane Operations (BSK) e.V., and Transfrigoroute Germany (TD) e.V. held numerous and intensive discussions at the state and federal levels in advance and pointed out the drastic economic consequences of these amendments to the StVO.
With the resolution of the Federal Council, as of 01.01.2021, the authorities are now responsible in whose district the permit-required transport begins as well as the authorities in whose district the company conducting the transport has its registered office or a branch according to § 13 Commercial Code.
Transitional Regulation Adopted Until Mid-2021
Furthermore, the Federal Council adopted a transitional regulation until 31.06.2021 for the use of radios, which are necessary for communication among truck drivers with accompanying vehicles during heavy transports: they are still allowed without hands-free devices until this date.
The background is that currently there are still no practical hands-free devices for radios available on the market.
