A decis\u00e3o, que foi proferida em 20 de fevereiro de 2026, diz respeito \u00e0 aplica\u00e7\u00e3o do International Emergency Economic Powers Act (IEEPA) e tem consequ\u00eancias significativas para as negocia\u00e7\u00f5es comerciais em andamento.<\/p>\n<p>Lange enfatizou que a decis\u00e3o da Suprema Corte tem implica\u00e7\u00f5es claras e inequ\u00edvocas que n\u00e3o podem ser ignoradas. Ele apontou que um neg\u00f3cio normal na situa\u00e7\u00e3o atual n\u00e3o \u00e9 poss\u00edvel. Um instrumento central que foi utilizado para negociar e implementar o acordo Turnberry n\u00e3o est\u00e1 mais dispon\u00edvel, o que torna a situa\u00e7\u00e3o consideravelmente mais incerta. Isso contraria os objetivos que deveriam ser alcan\u00e7ados com o acordo Turnberry, ou seja, estabilidade e previsibilidade no com\u00e9rcio.<\/p>\n<p>Outro ponto que Lange abordou \u00e9 a proposta de substitui\u00e7\u00e3o do IEEPA, conhecida como Se\u00e7\u00e3o 122. Esta nova se\u00e7\u00e3o se aplicaria indiscriminadamente a todos os pa\u00edses que exportam para os EUA e seria aplicada al\u00e9m das tarifas existentes de Na\u00e7\u00e3o Mais Favorecida (MFN). Isso significaria que as importa\u00e7\u00f5es da UE para os EUA estariam sujeitas a uma aplica\u00e7\u00e3o de tarifas que ultrapassa o limite de 15%.
