Para as cerca de 12.000 empresas de mensageria, expresso, correio e pacotes (KEP) de m\u00e9dio porte, as iniciativas planeadas nas \u00e1reas de legisla\u00e7\u00e3o postal, sal\u00e1rio m\u00ednimo e direito de contrata\u00e7\u00e3o s\u00e3o de import\u00e2ncia central.<\/strong><\/h5>\n<p>&nbsp;<\/p>\n<p>(Berlim) O contrato de coliga\u00e7\u00e3o aborda quest\u00f5es importantes \u2013 na vis\u00e3o do BdKEP, no entanto, \u00e9 necess\u00e1rio um desenvolvimento concreto e orientado para as PME para garantir de forma sustent\u00e1vel a competitividade e a cria\u00e7\u00e3o de valor na regi\u00e3o.<\/p>\n<h5>Legisla\u00e7\u00e3o Postal: Regular a situa\u00e7\u00e3o de entrega de forma pr\u00e1tica<\/h5>\n<p>A anunciada evolu\u00e7\u00e3o da legisla\u00e7\u00e3o postal e dos regulamentos legais associados \u00e9 expressamente bem-vinda pelo BdKEP. \u00c9 especialmente positivo que a participa\u00e7\u00e3o das empresas afetadas esteja prevista.<\/p>\n<p>No \u00e2mbito da regulamenta\u00e7\u00e3o legal, a situa\u00e7\u00e3o de entrega deve ser considerada de forma diferenciada: enquanto os carrinhos de m\u00e3o s\u00e3o pr\u00e1ticos em superf\u00edcies planas ou na entrega atrav\u00e9s de rampas, eles encontram limites nos andares superiores de edif\u00edcios multifamiliares. Aqui, s\u00e3o necess\u00e1rias regulamenta\u00e7\u00f5es claras e realistas em termos de trabalho. O BdKEP defende o uso de instrumentos comprovados, como o m\u00e9todo de refer\u00eancia para avalia\u00e7\u00e3o ergon\u00f4mica das condi\u00e7\u00f5es de trabalho.<\/p>\n<p>Al\u00e9m disso, h\u00e1 o receio de que os requisitos de confiabilidade dos contratados sejam dilu\u00eddos. Os contratantes n\u00e3o precisariam mais temer serem responsabilizados por viola\u00e7\u00f5es legais de seus subcontratados. Isso traz o risco de que empresas que atuam de forma desonesta possam operar com baixo risco e, assim, os PME que atuam de acordo com a lei sejam sistematicamente deslocadas.<\/p>\n<h5>A responsabilidade por a\u00e7\u00f5es legais n\u00e3o deve ser minada<\/h5>\n<p>Em rela\u00e7\u00e3o \u00e0 responsabilidade dos contratantes de KEP quanto \u00e0 utiliza\u00e7\u00e3o de subcontratados que atuam de acordo com a lei (por exemplo, condi\u00e7\u00f5es de trabalho), deve-se garantir, na vis\u00e3o do BdKEP, que empresas que atuam ilegalmente sejam expulsas do mercado. Para isso, devem ser encontrados procedimentos que n\u00e3o possam ser contornados, permitindo que os contratantes se isentem facilmente de responsabilidade ou que os subcontratados sejam classificados como confi\u00e1veis, apesar das viola\u00e7\u00f5es das regras. Aqui, existe o risco de que as regulamenta\u00e7\u00f5es sejam reduzidas sob o pretexto de redu\u00e7\u00e3o da burocracia, de modo que empresas que atuam ilegalmente possam operar no mercado com baixo risco.<\/p>\n<h5>Sal\u00e1rio M\u00ednimo: Confiabilidade atrav\u00e9s da realidade econ\u00f4mica<\/h5>\n<p>O fortalecimento planejado da independ\u00eancia da comiss\u00e3o do sal\u00e1rio m\u00ednimo \u00e9 um sinal importante. O BdKEP apoia expressamente este passo. Ao mesmo tempo, deve-se garantir que, ao definir os futuros sal\u00e1rios m\u00ednimos, a viabilidade econ\u00f4mica das pequenas e m\u00e9dias empresas seja suficientemente considerada \u2013 especialmente em uma situa\u00e7\u00e3o econ\u00f4mica desafiadora.<\/p>\n<h5>Direito de Contrata\u00e7\u00e3o: Condi\u00e7\u00f5es de mercado justas para as PME<\/h5>\n<p>O BdKEP v\u00ea com especial preocupa\u00e7\u00e3o as mudan\u00e7as sugeridas no direito de contrata\u00e7\u00e3o sob o pretexto de \u201credu\u00e7\u00e3o da burocracia\u201d. A \u00eanfase em uma suposta orienta\u00e7\u00e3o favor\u00e1vel \u00e0s PME contrasta com medidas planejadas, como a elimina\u00e7\u00e3o pr\u00e1tica da divis\u00e3o de lotes. A elimina\u00e7\u00e3o de lotes obrigat\u00f3rios leva ao fato de que as empresas de m\u00e9dio porte n\u00e3o podem mais licitar de forma independente. Em vez disso, elas se tornam subcontratadas dependentes, enquanto a verdadeira cria\u00e7\u00e3o de valor permanece com grandes empresas e corpora\u00e7\u00f5es.<\/p>\n<h5>Conclus\u00e3o<\/h5>\n<p>O BdKEP exige uma implementa\u00e7\u00e3o consistentemente orientada para as PME das iniciativas formuladas no contrato de coliga\u00e7\u00e3o. Mudan\u00e7as legislativas n\u00e3o devem levar a que a redu\u00e7\u00e3o da burocracia se torne uma eros\u00e3o das regras de mercado.
