O tribunal acolhe o recurso da operadora de terminais privada Swissterminal AG contra a WEKO. Esta \u00e9 instru\u00edda a seguir a recomenda\u00e7\u00e3o do Comiss\u00e1rio Federal de Prote\u00e7\u00e3o de Dados. A WEKO deve conceder \u00e0 Swissterminal AG acesso total aos autos do processo ou, dentro de um prazo, emitir uma decis\u00e3o pass\u00edvel de recurso.<\/p>\n<p>(Frenkendorf) No contexto do controverso megaterminal Gateway Basel Nord (GBN), a Comiss\u00e3o de Concorr\u00eancia WEKO j\u00e1 causou surpresa repetidamente. Primeiro, a WEKO aprovou um projeto que &#8220;pode eliminar a concorr\u00eancia efetiva&#8221;. Em seguida, negou aos afetados o acesso aos documentos relevantes para a decis\u00e3o. E, por fim, ignorou tamb\u00e9m a recomenda\u00e7\u00e3o do Comiss\u00e1rio Federal de Prote\u00e7\u00e3o de Dados, bem como a legisla\u00e7\u00e3o em vigor. Com a decis\u00e3o de 7 de dezembro de 2020, o Tribunal Administrativo Federal agora chama a WEKO \u00e0 raz\u00e3o. O tribunal acolhe o recurso da Swissterminal AG e instrui a WEKO a seguir a recomenda\u00e7\u00e3o do Comiss\u00e1rio Federal de Prote\u00e7\u00e3o de Dados. A WEKO deve conceder \u00e0 Swissterminal AG acesso total aos autos do processo ou, dentro de um prazo, emitir uma decis\u00e3o que possa ser contestada. Ambas as op\u00e7\u00f5es foram at\u00e9 agora negadas pela WEKO.<\/p>\n<h5><strong>Luz Verde Apesar da Elimina\u00e7\u00e3o da Concorr\u00eancia<\/strong><\/h5>\n<p> A luz verde, apesar da elimina\u00e7\u00e3o da concorr\u00eancia, \u00e9 objeto da disputa legal e uma decis\u00e3o controversa da WEKO. Esta anunciou em junho de 2019, de forma surpreendente, que n\u00e3o tinha obje\u00e7\u00f5es ao projeto de fus\u00e3o em torno do controverso megaterminal Gateway Basel Nord. Embora o terminal planejado \u2013 segundo a WEKO \u2013 &#8220;possa eliminar a concorr\u00eancia efetiva no manuseio de cont\u00eaineres, unidades de carga e semirreboques no com\u00e9rcio de importa\u00e7\u00e3o e exporta\u00e7\u00e3o&#8221;. No entanto, o projeto melhora as condi\u00e7\u00f5es de concorr\u00eancia no transporte de mercadorias por ferrovia (os chamados motivos de efici\u00eancia). Este recomendou \u00e0 WEKO em sua decis\u00e3o de 4 de mar\u00e7o de 2020 \u2013 sob a condi\u00e7\u00e3o da anonimiza\u00e7\u00e3o dos dados pessoais aceita pela Swissterminal \u2013 o acesso total \u00e0s informa\u00e7\u00f5es solicitadas. No entanto, a WEKO n\u00e3o seguiu essa recomenda\u00e7\u00e3o do Comiss\u00e1rio Federal de Prote\u00e7\u00e3o de Dados.
