UPS and ASL did not succeed


The CEP giant UPS has failed with a billion dollar lawsuit against the EU commission in the European Union General Court in Luxembourg. Two Irish air freight companies had also claimed damages for lost profits in the amount of EUR 263 million in the same context.

 

The background was a decision by the Brussels authorities in 2013 which prohibited a merger between UPS and the company TNT. The court decided that UPS could not provide sufficient evidence that the EU Commission's errors in prohibiting the merger caused the alleged damage and therefore dismissed the claim for damages of approximately EUR 1.7 billion.

 

Furthermore, the court ruled that ASL Aviation Holdings had not proven that the decision of the EU Commission at that time contained sufficiently qualified violations of Union law to justify a claim for damages. The court therefore dismissed the action as unfounded. (sh)
