Road tolls: ECJ rules in favour of Polish forwarder
The levy of road tolls on trucks in Germany may not include police costs, as the European Court of Justice ruled yesterday (28.10.2020), approving a Polish freight forwarder's claim. The company had brought a case in Germany, claiming the restitution of road tolls billed for the use of motorways from 2010 to 2011.
In its ruling, the ECJ found that the level of the toll must be based exclusively on infrastructure costs, namely the construction and operation, maintenance and extension of the relevant transport network.
In a press release, the German federal association of road haulage, logistics and disposal BLG welcomed the fact that the ECJ had clarified basic questions with regard to the method of calculation for road tolls and thus provided legal certainty. (ben)
