Des amendes \u00e9lev\u00e9es ont \u00e9t\u00e9 prononc\u00e9es.<\/strong><\/h5>\n<p>(K\u00f6ln) Une entreprise de transport du sud-ouest de l&rsquo;Allemagne a engag\u00e9, en l&rsquo;espace de quelques mois, deux transporteurs \u00e9trangers pour un total de 449 transports, qui ont \u00e9t\u00e9 effectu\u00e9s en violation des r\u00e8gles de cabotage. Concr\u00e8tement, les transporteurs n&rsquo;avaient pas effectu\u00e9 de transports transfrontaliers au pr\u00e9alable ou n&rsquo;avaient pas respect\u00e9 la p\u00e9riode de refroidissement de quatre jours (Cooling-off-Phase) apr\u00e8s trois transports de cabotage.<\/p>\n<p>Tous les donneurs d&rsquo;ordre commerciaux de services de transport ont l&rsquo;obligation de s&rsquo;assurer que les entrepreneurs qu&rsquo;ils engagent disposent d&rsquo;une autorisation valide (par exemple, une licence communautaire, abr\u00e9g\u00e9e : licence UE) et qu&rsquo;ils ne l&rsquo;utilisent pas de mani\u00e8re inacceptable.<\/p>\n<p>Le donneur d&rsquo;ordre n&rsquo;a pas suffisamment v\u00e9rifi\u00e9 ou assur\u00e9 que les r\u00e8gles de cabotage \u00e9taient respect\u00e9es par les deux transporteurs.<\/p>\n<h5><strong>Amendes pour les entreprises et les dirigeants<\/strong><\/h5>\n<p>Le tribunal de district de Cologne a sanctionn\u00e9 les services de transport effectu\u00e9s de mani\u00e8re inacceptable par la confiscation de 72 700 EUR ainsi que des amendes contre le directeur responsable d&rsquo;un montant total de 17 928 EUR.<\/p>\n<h5><strong>Extrait de la brochure sur la responsabilit\u00e9 de l&#8217;employeur<\/strong><\/h5>\n<p>Pour se conformer \u00e0 ses obligations en vertu de l&rsquo;article 7c de la G\u00fcKG, le donneur d&rsquo;ordre doit en principe faire tout ce qui est raisonnablement possible pour s&rsquo;assurer que le transporteur ex\u00e9cutant (transporteur) dispose d&rsquo;une autorisation ou d&rsquo;un droit en vertu de la G\u00fcKG et des permis de travail ou certificats de conducteur n\u00e9cessaires pour le personnel de conduite engag\u00e9.
