Celle-ci a \u00e9t\u00e9 fond\u00e9e par le groupement de transporteurs ELVIS AG pour regrouper les revendications de 350 petites et moyennes entreprises de transport. Selon le tribunal, Themis n&rsquo;a pas exerc\u00e9 d&rsquo;activit\u00e9 de recouvrement autoris\u00e9e, mais a fourni un conseil juridique. Les cessions de droits \u00e9ventuels \u00e0 des dommages-int\u00e9r\u00eats li\u00e9s au cartel \u00e0 son profit seraient donc nulles en raison de violations des \u00a7\u00a7 3 et 4 de la loi sur les services juridiques, ce qui signifie que Themis n&rsquo;est pas devenue titulaire de droits \u00e0 des dommages-int\u00e9r\u00eats en mati\u00e8re de droit de la concurrence, \u00e9crit le tribunal dans son communiqu\u00e9 de presse.<\/p>\n<h5><strong>Derni\u00e8re modification de la loi sur les services juridiques non prise en compte<\/strong><\/h5>\n<p>Lorenz : \u00ab\u00a0Nous ne partageons toujours pas cet avis, car il ne prend pas en compte la derni\u00e8re modification de la loi sur les services juridiques ni la jurisprudence r\u00e9cente de la Cour f\u00e9d\u00e9rale de justice, qui a consid\u00e9rablement \u00e9largi le champ d&rsquo;application des actions collectives en mati\u00e8re de recouvrement en Allemagne avec son jugement du 13 juillet 2021 (Az. II ZR 84\/20). Nous aurions souhait\u00e9 que le tribunal de grande instance de Stuttgart se montre plus ouvert \u00e0 la revendication group\u00e9e de dommages-int\u00e9r\u00eats.\u00a0\u00bb<\/p>\n<h5>\u00c0 propos :<\/h5>\n<p>La Commission europ\u00e9enne a condamn\u00e9, par d\u00e9cision du 19 juillet 2016 (AT.39824 \u2013 Trucks), plusieurs fabricants de v\u00e9hicules utilitaires, dont Daimler AG, \u00e0 une amende de plusieurs milliards d&rsquo;euros pour des pratiques anticoncurrentielles.<\/p>\n<p>Themis Schaden GmbH exige sur cette base et en vertu de droits c\u00e9d\u00e9s le paiement de dommages-int\u00e9r\u00eats li\u00e9s au cartel d&rsquo;un montant d&rsquo;environ 96 millions d&rsquo;euros, plus int\u00e9r\u00eats, ainsi que la reconnaissance d&rsquo;une obligation d&rsquo;indemnisation des d\u00e9fendeurs pour d&rsquo;autres dommages li\u00e9s au cartel.<\/p>\n<h5><strong>Cr\u00e9ation dans le domaine des services de recouvrement<\/strong><\/h5>\n<p>Themis Schaden GmbH a \u00e9t\u00e9 fond\u00e9e en octobre 2016 par la soci\u00e9t\u00e9 de transport international ELVIS Aktiengesellschaft en tant que filiale \u00e0 100 % et a \u00e9t\u00e9 enregistr\u00e9e en f\u00e9vrier 2017 conform\u00e9ment \u00e0 l&rsquo;article 10, paragraphe 1, phrase 1, num\u00e9ro 1 de la loi sur les services juridiques aupr\u00e8s de l&rsquo;autorit\u00e9 comp\u00e9tente pour le domaine des services de recouvrement. Les entreprises sont en grande partie membres d&rsquo;ELVIS et exercent des activit\u00e9s dans le domaine des services de transport.
