Selon la Cour de justice de l&rsquo;Union europ\u00e9enne, les co\u00fbts de la police de la circulation ne sont pas des co\u00fbts d&rsquo;infrastructure \u00e0 prendre en compte dans le calcul des frais de p\u00e9age pour les camions.<\/p>\n<p>(Francfort-sur-le-Main\/Luxembourg) \u2013 Les co\u00fbts de la police de la circulation ne doivent pas \u00eatre pris en compte lors de la perception des p\u00e9ages pour camions en Allemagne. C&rsquo;est ce qu&rsquo;a d\u00e9cid\u00e9 aujourd&rsquo;hui la Cour de justice de l&rsquo;Union europ\u00e9enne (CJUE), donnant ainsi raison \u00e0 une entreprise de transport polonaise. Celle-ci avait intent\u00e9 une action en Allemagne pour le remboursement des frais de p\u00e9age des ann\u00e9es 2010 \u00e0 2011. Le tribunal administratif sup\u00e9rieur du Land de Rh\u00e9nanie-du-Nord-Westphalie \u00e0 M\u00fcnster avait soumis \u00e0 la CJUE des questions concernant l&rsquo;interpr\u00e9tation de la directive pertinente sur les co\u00fbts des routes dans le cadre d&rsquo;une proc\u00e9dure de d\u00e9cision pr\u00e9judicielle selon l&rsquo;article 267 TFUE (affaire C-321\/19).<\/p>\n<h5><strong>Uniquement des co\u00fbts d&rsquo;infrastructure pour la d\u00e9termination des frais de p\u00e9age<\/strong><\/h5>\n<p>La CJUE constate dans son jugement que pour la d\u00e9termination des frais de p\u00e9age, seuls les co\u00fbts d&rsquo;infrastructure, c&rsquo;est-\u00e0-dire pour la construction ainsi que l&rsquo;exploitation, l&rsquo;entretien et l&rsquo;extension du r\u00e9seau routier concern\u00e9, doivent \u00eatre pris en compte. \u00ab\u00a0Les activit\u00e9s polici\u00e8res rel\u00e8vent de la responsabilit\u00e9 de l&rsquo;\u00c9tat, qui exerce des pouvoirs souverains et n&rsquo;agit pas uniquement en tant qu&rsquo;exploitant de l&rsquo;infrastructure routi\u00e8re\u00a0\u00bb, ont d\u00e9clar\u00e9 les juges europ\u00e9ens. Les co\u00fbts de la police de la circulation ne peuvent donc pas \u00eatre consid\u00e9r\u00e9s comme des co\u00fbts d&rsquo;exploitation au sens de la directive sur la perception des frais.<br \/>Concernant le fait que les co\u00fbts d&rsquo;infrastructure dans le cas pr\u00e9sent sont seulement l\u00e9g\u00e8rement d\u00e9pass\u00e9s en raison de la prise en compte des co\u00fbts de la police de la circulation, la Cour constate que la directive sur les co\u00fbts des routes s&rsquo;oppose, entre autres, \u00e0 tout d\u00e9passement des co\u00fbts d&rsquo;infrastructure en raison de la prise en compte de co\u00fbts non admissibles.<\/p>\n<h5><strong>BGL se f\u00e9licite de la d\u00e9cision<\/strong><\/h5>\n<p>Le BGL se f\u00e9licite que des questions fondamentales concernant la proc\u00e9dure de calcul des p\u00e9ages aient \u00e9t\u00e9 clarifi\u00e9es par la CJUE. En particulier, la prise en compte des co\u00fbts de la police de la circulation dans le calcul des p\u00e9ages avait \u00e9t\u00e9 remise en question par le BGL dans le pass\u00e9 et abord\u00e9e dans ses actions types en mati\u00e8re de p\u00e9age de 2009.
