Nando Stauffer von May, d\u00e9crit dans un article sp\u00e9cialis\u00e9 les dangers auxquels les transporteurs sont confront\u00e9s lorsque des conteneurs restent dans les ports, car les conteneurs en provenance d&rsquo;Extr\u00eame-Orient ont d\u00e9sormais atteint les ports europ\u00e9ens, mais les usines sont ferm\u00e9es ici.<\/p>\n<p>Par Nando Stauffer von May<\/p>\n<p>(Zurich) De nombreuses entreprises europ\u00e9ennes ont command\u00e9 des marchandises en provenance de Chine au cours des premiers mois de cette ann\u00e9e. La Chine \u00e9tait en pleine crise du coronavirus et les mesures prises par le gouvernement ont consid\u00e9rablement retard\u00e9 la production et l&rsquo;exp\u00e9dition des marchandises, si bien que de nombreux produits n&rsquo;arrivent en Europe qu&rsquo;\u00e0 la fin du printemps. Les entreprises locales ont \u00e9galement \u00e9t\u00e9 touch\u00e9es par les mesures impos\u00e9es en raison du virus Covid-19. Nombreuses sont celles qui ont encore des stocks pleins ou qui n&rsquo;ont actuellement pas besoin des marchandises command\u00e9es pour d&rsquo;autres raisons. De nombreuses entreprises font \u00e9galement face \u00e0 des difficult\u00e9s financi\u00e8res. Les ports europ\u00e9ens s&rsquo;attendent donc \u00e0 ce que les conteneurs restent plus longtemps dans le port. Il existe \u00e9galement un risque que les marchandises ne soient pas du tout r\u00e9ceptionn\u00e9es.<\/p>\n<p><strong>Des frais de d\u00e9murrage ou de d\u00e9tention sont \u00e0 pr\u00e9voir<\/strong><\/p>\n<p>Lorsque les marchandises restent plus longtemps dans le port et dans le conteneur, des frais de <em>d\u00e9murrage<\/em> et de <em>d\u00e9tention<\/em> s&rsquo;appliquent. Le <em>d\u00e9murrage<\/em> d\u00e9signe le temps d&rsquo;attente du conteneur dans le port jusqu&rsquo;\u00e0 son enl\u00e8vement. La <em>d\u00e9tention<\/em>, en revanche, repr\u00e9sente une p\u00e9nalit\u00e9 pour le retard dans le retour du conteneur d\u00e9charg\u00e9. Depuis l&rsquo;effondrement des taux de fret, les <em>d\u00e9murrage<\/em> et <em>d\u00e9tention<\/em> peuvent repr\u00e9senter une part non n\u00e9gligeable des co\u00fbts de transport. Ces deux frais sont factur\u00e9s par la compagnie maritime en plus du fret, c&rsquo;est-\u00e0-dire du montant r\u00e9el pour le transport. Si une entreprise laisse les marchandises dans le conteneur au port pendant une longue p\u00e9riode, des co\u00fbts consid\u00e9rables s&rsquo;accumulent.<\/p>\n<p>Dans le cadre d&rsquo;un transport <em>Freight Collect<\/em>, la compagnie maritime percevra les frais de transport aupr\u00e8s du <em>Consignee<\/em> conform\u00e9ment au <em>B\/L<\/em>, c&rsquo;est-\u00e0-dire aupr\u00e8s du destinataire selon le document de transport, lors de la collecte des marchandises. Dans le cadre d&rsquo;un transport <em>Freight Pre-Paid<\/em>, le fret a d\u00e9j\u00e0 \u00e9t\u00e9 pay\u00e9 par l&rsquo;exp\u00e9diteur ou le transporteur, ou du moins l&rsquo;obligation de paiement a \u00e9t\u00e9 assum\u00e9e. Contractuellement, c&rsquo;est-\u00e0-dire dans les conditions de transport (<em>Terms of Carriage<\/em>), il est souvent convenu que tant l&rsquo;exp\u00e9diteur (<em>Shipper<\/em>) que le destinataire (<em>Consignee<\/em>) et souvent d&rsquo;autres personnes sont responsables des <em>d\u00e9murrage<\/em> et <em>d\u00e9tention<\/em>. Les conditions de transport pr\u00e9voient \u00e9galement, dans le cadre d&rsquo;un transport <em>Freight Collect<\/em>, la co-responsabilit\u00e9 de l&rsquo;exp\u00e9diteur et du donneur d&rsquo;ordre pour le fret.<\/p>\n<p>Si le destinataire ne r\u00e9cup\u00e8re pas les conteneurs en raison d&rsquo;une faillite ou d&rsquo;une d\u00e9pr\u00e9ciation de la marchandise, l&rsquo;exp\u00e9diteur sera g\u00e9n\u00e9ralement responsable envers la compagnie maritime pour le fret ainsi que pour les <em>d\u00e9murrage<\/em> et <em>d\u00e9tention<\/em>. Si un transporteur agit en tant qu&rsquo;exp\u00e9diteur, il est \u00e9galement responsable du fret ainsi que des <em>d\u00e9murrage<\/em> et <em>d\u00e9tention<\/em>. De plus, la marchandise transport\u00e9e \u00ab\u00a0est responsable\u00a0\u00bb en raison du droit de r\u00e9tention du transporteur et \u00e9ventuellement d&rsquo;un droit de gage contractuellement convenu en faveur du transporteur (compagnie maritime) pour les co\u00fbts de transport.<\/p>\n<p>Dans la mesure o\u00f9 le transporteur est responsable, il sera g\u00e9n\u00e9ralement bien avis\u00e9 de r\u00e9cup\u00e9rer la marchandise au port afin de minimiser au moins les <em>d\u00e9murrage<\/em> et <em>d\u00e9tention<\/em> et de stocker la marchandise de mani\u00e8re plus \u00e9conomique si n\u00e9cessaire.
