Seg\u00fan el Tribunal de Justicia de la Uni\u00f3n Europea, los costos de la polic\u00eda de tr\u00e1fico no son costos de infraestructura que deben tenerse en cuenta al calcular las tarifas de peaje para camiones.<\/p>\n<p>(Fr\u00e1ncfort del Meno\/Luxemburgo) \u2013 Los costos de la polic\u00eda de tr\u00e1fico no deben ser calculados al recaudar el peaje para camiones en Alemania. As\u00ed lo decidi\u00f3 hoy el Tribunal de Justicia de la Uni\u00f3n Europea (TJUE), dando la raz\u00f3n a una empresa de transporte polaca. Esta hab\u00eda presentado una demanda en Alemania para la devoluci\u00f3n de las tarifas de peaje de los a\u00f1os 2010 a 2011. El Tribunal Administrativo Superior del Estado de Renania del Norte-Westfalia en M\u00fcnster hab\u00eda planteado al TJUE preguntas sobre la interpretaci\u00f3n de la directiva de costos de carretera relevante en el marco de un procedimiento de decisi\u00f3n prejudicial seg\u00fan el Art. 267 TFUE (Asunto C-321\/19).<\/p>\n<h5><strong>Solo costos de infraestructura para establecer las tarifas de peaje<\/strong><\/h5>\n<p>El TJUE establece en su sentencia que al fijar las tarifas de peaje solo deben tenerse en cuenta los costos de infraestructura, es decir, para la construcci\u00f3n, operaci\u00f3n, mantenimiento y expansi\u00f3n de la red de carreteras en cuesti\u00f3n. \u00abLas actividades policiales son responsabilidad del Estado, que ejerce poderes soberanos y no act\u00faa \u00fanicamente como operador de la infraestructura vial\u00bb, dictaminaron los jueces europeos. Por lo tanto, los costos de la polic\u00eda de tr\u00e1fico no pueden considerarse costos de operaci\u00f3n en el sentido de la directiva sobre la recaudaci\u00f3n de tarifas. En cuanto a la circunstancia de que los costos de infraestructura en el presente caso se superan solo en una medida relativamente peque\u00f1a debido a la consideraci\u00f3n de los costos de la polic\u00eda de tr\u00e1fico, el Tribunal establece que la directiva de costos de carretera se opone, entre otras cosas, a cualquier superaci\u00f3n de los costos de infraestructura debido a la consideraci\u00f3n de costos no deducibles.<\/p>\n<h5><strong>BGL da la bienvenida a la decisi\u00f3n<\/strong><\/h5>\n<p>El BGL da la bienvenida a que se hayan aclarado cuestiones fundamentales sobre el procedimiento de c\u00e1lculo de peajes por el TJUE. En particular, la deducibilidad de los costos de la polic\u00eda de tr\u00e1fico en el c\u00e1lculo del peaje hab\u00eda sido cuestionada por el BGL en el pasado y abordada en sus demandas modelo de peaje de 2009. Con su decisi\u00f3n de hoy, el TJUE ha proporcionado seguridad jur\u00eddica para nuestras empresas miembros.
