Das Verwaltungsgericht st\u00fctzte seine Entscheidung auf ein im Jahre 2020 vom Bundesverband Paket und Expresslogistik (BIEK) erwirktes Urteil des Bundesverwaltungsgerichts, das bereits die vorhergehende Portogenehmigung 2015 als rechtswidrig aufgehoben hatte. Aus Sicht des Gerichts heilt die daraufhin vom Bundestag beschlossene \u00c4nderung des Postgesetzes im Jahre 2021 die Rechtsfehler der Portogenehmigung nicht. Neben dem BIEK hatten die Deutsche Rentenversicherung, die Rechtsanwaltskammer Berlin sowie die Unternehmen Arriva, Postcon, PIN und Letterei gegen die Genehmigung geklagt.<\/strong><\/h5>\n

(Berlin) Der BIEK-Vorsitzende Marten Bosselmann begr\u00fc\u00dft die Entscheidung des Verwaltungsgerichts. Dazu erkl\u00e4rt er: \u201eDas Urteil best\u00e4tigt unsere Rechtsposition erneut. Indem die BNetzA unt\u00e4tig geblieben ist, hat sie \u00fcberh\u00f6hte Porti zu Lasten der Briefkundinnen und -kunden hingenommen. Zudem hat sie der DPAG erhebliche Wettbewerbsverzerrungen auf dem Paketmarkt erm\u00f6glicht. Die aktuelle Rechtslage, nach der unrechtm\u00e4\u00dfige Gewinne in einer solchen Gr\u00f6\u00dfenordnung bei der DPAG verbleiben k\u00f6nnen, muss dringend ge\u00e4ndert werden. Eine verbraucher- und wettbewerbsfreundliche Novelle des Postgesetzes ist l\u00e4ngst \u00fcberf\u00e4llig!\u201c<\/p>\n
