Februar 2026 in der Rechtssache C-367\/22 P die Berufungen mehrerer Fluggesellschaften im Zusammenhang mit dem langwierigen Luftfracht-Kartellverfahren weitgehend abgewiesen. Damit wurden die von der Europ\u00e4ischen Kommission im Jahr 2017 verh\u00e4ngten hohen Geldstrafen best\u00e4tigt und die Zust\u00e4ndigkeit der EU f\u00fcr eingehende Frachtleistungen klargestellt.<\/p>\n<p>Die Kommission hatte festgestellt, dass zwischen 1999 und 2006 eine koordinierte Vorgehensweise bei der Festlegung von Treibstoff- und Sicherheitszuschl\u00e4gen sowie die Weigerung, Provisionen auf diese Zuschl\u00e4ge zu zahlen, vorlag. Dies stellte einen fortlaufenden Verstoss gegen Artikel 101 des Vertrags \u00fcber die Arbeitsweise der Europ\u00e4ischen Union (AEUV), Artikel 53 des EWR-Abkommens sowie Artikel 8 des Luftverkehrsabkommens zwischen der EU und der Schweiz dar. Lufthansa erhielt im Rahmen des Kronzeugenprogramms Immunit\u00e4t.<\/p>\n<p>Die best\u00e4tigten Geldstrafen betreffen insbesondere die Fluggesellschaften Air France-KLM (310 Mio. EUR &#8211; Air France 183 Mio. EUR und KLM 127 Mio. EUR), British Airways (104 Mio. EUR), Lufthansa (79 Mio. EUR), die als Kronzeugin auf eine Milderung des Strafmasses gehofft hatte, Singapore Airlines (74 Mio. EUR), Cargolux (79 Mio. EUR), Cathay Pacific (57 Mio. EUR), Japan Airlines (35 Mio. EUR), Martinair (29 Mio. EUR), Air Canada (21 Mio. EUR) und LATAM\/Lan Cargo (8 Mio. EUR).<\/p>\n<p>Die SAS Cargo Group war die einzige Fluggesellschaft, die eine substantielle Anpassung ihrer Strafe erhielt (von 70 auf 63 Mio. EUR). Der EuGH stellte fest, dass das Gericht erster Instanz bei der Neuberechnung der Strafe Fehler gemacht hatte, insbesondere bei der Bewertung der Umsatzbestandteile. Das Urteil wurde daher teilweise aufgehoben und die Strafe entsprechend reduziert.<\/p>\n<p>Dar\u00fcber hinaus best\u00e4tigte der EuGH, dass das Wettbewerbsrecht der EU auch f\u00fcr eingehende Frachtleistungen gilt, wenn das Verhalten vorhersehbare, unmittelbare und erhebliche Auswirkungen innerhalb des Europ\u00e4ischen Wirtschaftsraums (EWR) hat. Mit der weitgehenden Abweisung der Berufungen markiert das Urteil das endg\u00fcltige Ende eines der bedeutendsten Kartellverfahren im Luftfahrtsektor auf EU-Ebene.<\/p>\n<p>&nbsp;<\/p>\n<p><a
